01 October 2006At the beginning of October, 2006 Mr. Miroslav Ognyanov, Partner in Dimitrov, Petrov & Co. took part in the European conference of the International Technology Law Association (ITechLaw) which was held in Prague. In the course of two days important legal aspects contemporary technologies and telecommunications were covered and discussed. At a seminar, dedicated to outsourcing of software product development in Central and Eastern Europe, Miroslav Ognyanov, Attorney-at-Law, presented the comparative outsourcing advantages of Bulgaria in the development of IT products and services. During the conference Miroslav Ognyanov, Attorney-at-Law, was elected as the Local Representative for Bulgaria of the ItechLaw Association ItechLaw’s Local Representative for Bulgaria.***
In November, experts from the Center for Law of Information and Communication Technologies (CLICT) initiated a consecutive public discussion on introducing the service “numbers portability” by the mobile operators in the country. According to the requirements of the European Union this should happen as of January 1st, 2007.
The amount of individual subsidies which the government may grant without asking for approval from the EU has increased from €100 000 to €200 000. This is a result of the decision of the European Commission to simplify the rules, aiming to help the small companies. Subsidies for companies in difficulties and for those, for which a prior valuation cannot be made, were stroked off for the purpose of avoiding unfair. /The Delegation of the European Commission/***

According to the requirements of the European Union this should happen as of January 1st, 2007 with Bulgaria’s accession in the EU. Despite of the optimism of CLICT representatives, the question remains open. According to representatives of Mobiltel most probably the introduction of the service will not be possible within a month. The numbers portability was already introduced in the EU countries last year. Nevertheless, in many cases, there were delays, which provoked official letters, warnings and some judicial proceedings on behalf of the European Commission against the Czech Republic, Lithuania, Poland, Latvia, Malta and Slovenia /The Mobile Gate/***
The Interdisciplinary International Conference on ‘Investors Targeting’ took place on November 29, 2006 in Grand Hotel Sofia. Representatives of different scientific, consultant and media institutions took part. Mr. Alexander Todorov, Partner in Dimitrov, Petrov and Co. Law Firm presented the legal aspects of the problem delivering a lecture titled: “Legal regime of the investments in Bulgaria”.
Evidence of the importance of the meeting is the participation of experts, such as: Christopher Goodwin, Senior Manager, International Financial Services, London; Rumen Radev, Vice Chairman of the Governing Board of the Bulgarian Industrial Capital Association (BICA); Richard Davis, Deputy Chairmen of The Investor Relations Society; Plamen Chipev, Senior Research Associate in the Institute of Economics, BAS etc.***
At the end of November 2006 a regional meeting of countries from the Balkan Region and MERITAS. – an international association of independent law firms and lawyers - was held. The main subject matter of the meeting was discussing the common politics for client service and exchanging information on new investment projects. George Dimitrov, Attorney-at-Law, took part in the meeting as the representative of Dimitrov, Petrov and Co. Law Firm. ***
Mr. George Dimitrov took part in the International Conference on E-business, organized by the European Commission at the end of November 2006 in Brussels. He was invited as a delegate representing Bulgaria with regard to the discussions on e-business and e-trade development in the country.***
At the beginning of December 2006 a meeting between а Bulgarian delegation, led by the Vice-Minister of Public Health in Bulgaria and deputies of the European Commission took place in Brussels. Mr. George Dimitrov, Partner in Dimitrov, Petrov & Co. was one of the delegates. He took part in the meeting in connection with the development of the legislative frame of the e-health services in Bulgaria and the harmonization of the Bulgarian legislation with the requirements of the EU.***
With a resolution from December 2006 a five member panel of the Supreme Administrative Court (SAC) confirmed at final instance an inflicted penalty on BTC Ltd. The penalty amounts to 50 000 BGN and is imposed on BTC for abuse with dominant position as well as the liability to prepare and offer agreements for bitstream access to Internet suppliers, set by decision N 179/2005 of the Commission for Protection of Competition (CPC).
In June, 2006 the Society for Electronic Communications (SEC), represented by Dimitrov, Petrov & Co. Law Firm, deposited a complaint in the Commission for Protection of Competition regarding the refusal of BTC to provide bitstream access. After the decision of the five member panel every follow up refusal of BTC to meet the demands for concluding agreements for bitstream access shall be considered as a dereliction of an administrative act in force – the decision of the CPC.***
The Christmas Party of Dimitrov, Petrov & Co. Law Firm was held on 17/12/2006 in the Private Lounge of the Maleevi Tennis Club. Within the New Year’s party program the Partners bestowed the prize for best new employee on Metodi Baykushev, Expert in the firm.***« Previous Next »
