On September 25, 2009 Ms. Boyana Milcheva, Senior Associate at Dimitrov Petrov & Co. Law Firm, was awarded a practice diploma in International Mergers and Acquisitions. The international postgraduate practice programme in International Mergers and Acquisitions was conducted from January to July, 2009. It was organized in the form of distance education by the International Bar Association and the College of Law of England and Wales - the UK’s leading provider of legal education and training, offering high-quality teaching combined with a focus on practical skills and innovative learning styles.
In the course of the programme Ms. Boyana Milcheva acquired and developed profound competence in the fundamentals and structure of international mergers and acquisitions focusing on the law and practice of England and Wales, and other European countries.
On September 8th, 2009 the European Court of Justice issued a judgment which brings some clarity on the question of prohibition of online gambling activities by Member States of the European Union (including Bulgaria). The judgment is on case C-42/07 concerning a reference for a preliminary ruling in the course of proceedings between, on the one hand, Liga Portuguesa de Futebol Profissional (Portugal) and Bwin International Ltd (with registered office in Gibraltar) and, on the other, Departamento de Jogos da Santa Casa da Misericordia de Lisboa concerning fines imposed on the Liga and Bwin by the directors of Santa Casa on the ground that they had infringed the Portuguese legislation governing the provision of certain games of chance via the internet.
In its findings the European Court of Justice once again accepted that the legislation of a Member State (in this case the Portuguese legislation) which prohibits providers such as Bwin, established in other Member States, from offering via the internet services in the territory of that first Member State constitutes a restriction on the freedom to provide services enshrined in Article 49 EC Treaty.
Nevertheless, in the light of the specific features associated with the provision of games of chance via the internet, the European Court of Justice considered that the restriction at issue in this particular case may be regarded as justified by the objective of combating fraud and crime. Thus the Portuguese legislation in question, was found to be compatible with the EC Treaty.
After this decision of the European Court of Justice, legislation of a Member State restricting the provision of online gambling services might be found compatible with the EU legislation, provided that it is justified as necessary, proportionate and non-discriminatory.
On September 25 – 26, 2009 Mr. Alexander Todorov, Partner at Dimitrov, Petrov & Co. Law Firm attended the Meritas European Regional Meeting in Oslo, Norway. Dimitrov, Petrov & Co. is a member of Meritas, an alliance of around 200 independent law firms worldwide. This year’s conference focused on discussing new ways of cooperation and improving coordination among the members of the alliance. Mr. Todorov participated in a stream of sessions dedicated to young partners and senior associates aiming to enlarge their management, marketing and interpersonal skills.
On September 25, 2009 in Sofia Dr. George Dimitrov, Partner at Dimitrov, Petrov & Co. Law Firm participated in a workshop entitled “Clusters, Cluster Associations and Incubators – Environment for Development of SMEs” in his capacity as a member of the Board of Directors of the Bulgarian ICT Cluster. The event was organized by the ICT cluster with the support of TAIEX (Technical Assistance Information Exchange Unit). Thе forum was dedicated to European initiatives for supporting clusters and cluster associations as well as the Bulgarian national policy for clusters support. Representatives of the Ministry of Economy, Energy and Tourism, the SME Promotion Agency, the Association of Business Clusters, etc.
Between September 15 – 17, 2009 Dr. George Dimitrov, Partner at Dimitrov, Petrov & Co. Law Firm was a lecturer in the Bulgarian-Russian Forum for Information Cooperation and Cybersecurity in the town of Nessebar. Dr. Dimitrov presented in detail the principles of the E-governance Act as well as the requirements for information security to administrative bodies. The event was organized by the Russian Ministry of Communications and Mass Communications, the Parliamentary Committee on Security, the Bulgarian Ministry of Transport, Information Technology and Communications and was co-chaired by their respective deputy ministers and deputy chairman of the Committee.
