Unprecedented compensation for nonpecuniary damages awarded to a client

Dimitrov, Petrov & Co. Law Firm (DPC) won a case for nonpecuniary damages with an unusually high amount of compensation for Bulgaria.

The case for compensation of damages was brought in connection with an incident which occurred on the premises of a major retail chain. While our client was shopping, a pallet was dropped by an electric car, resulting in a crushed toe and calf injury at the point of impact.

Encho Simeonov, senior associate, supported by the associates Yoanna Pantaleeva and Alexander Georgiev, convinced the court that the claim for nonpecuniary damages in the amount of BGN 50,000 was justified in view of the stress and suffering experienced by the plaintiff. The Sofia City Court upheld our client’s claim in full, which although being still a relatively rare case in the local case law, shows a trend for the Bulgarian court to award actually fair compensations in such cases.

The decision is subject to appeal to a higher instance.
